1. Theme and Plugin Licensing

Popcorn Theme and associated plugins, unless otherwise stated, are licensed under the GNU General Public License (http://www.gnu.org/licenses/gpl.html) version 2.0 or later.

2. Warranty

Themes and plugins sold and distributed by alexdigital LTD t/a Popcorn Theme. are done so in the hope that they will be useful, but WITHOUT ANY WARRANTY; without even the implied warranty of MERCHANTABILITY or FITNESS FOR A PARTICULAR PURPOSE.

Inasmuch as WordPress functions correctly on a clean install of itself, Popcorn Theme is guaranteed to function on a clean install of the minimum, stable and required version of WordPress for Popcorn Theme and extensions. Because the number and variety of plugins is vast and wide, we do not guarantee that the theme will function with all third-party plugins, themes or browsers of any kind. We do not assume responsibility and will not be held responsible for any conflicts or compatibility issues that may occur due to third-party software. We assume no responsibility for any data loss as a result of installing or using Popcorn Theme. Should conflicts occur with third-party software, we may provide support at our discretion.

3. Support

Alexdigital LTD sells and distributes Popcorn Theme and other plugins “as is” and with no implied meaning that they will function exactly as you would like, or that they will be compatible with all third-party components and plugins.

Support for Popcorn Theme and plugins sold and distributed by Alexdigital LTD is only available for those who have an active, paid license.

Support and updates are granted for one year after the original purchase based on the license you have purchased. After one year is completed, the purchaser must renew their license in order to continue receiving support and updates for the items purchased.

Support and updates for Popcorn Theme are provided as long as Popcorn Theme is actively in development. Should any one of the following occur, Alexdigital LTD will no longer be responsible for providing support for Popcorn Theme:

• Popcorn Theme is no longer actively developed as a viable product under Alexdigital LTD.
• Popcorn Theme or the parent company is purchased or bought out by another company.
• WordPress is no longer actively developed.

Whilst we attempt to provide the best support possible for our themes and plugins, we do not guarantee that any particular support query can, or will be answered to the extent, or within a timeframe that the inquirer is completely satisfied.

4. Automatic Updates

Automatic updates are available to license holders who have an active and valid subscription and license key. Automatic updates are available for Popcorn Theme and all other installed Popcorn Theme extensions. Automatic updates are available as long as the license key generated from the purchase is valid and active.

5. License Usage

Popcorn Theme grants each customer one or more license(s) to use the software for internal use, and as defined by the terms set in the customer’s chosen license package. Where the license package allows the software to be used on multiple sites the customer/license-holder may not redistribute the originally-purchased license key provided by Alexdigital LTD, to other users of the license (such as clients) for commercial benefit.

Additionally, the customer may not sublicense, to any person or entity, any rights to distribute the software or license key. Any license keys that are being redistributed against these terms will be permanently revoked. We will only provide support services to the original customer/license-holder with a legitimate license key, and consider any other uses of this license key for support queries as fraudulent.

Our lifetime license is valid for the lifetime of the product itself.

6. Theme Delivery

After we have processed your payment successfully, you will receive an email with your order number and other purchase information. Your license key is available in your account area along with your downloads. You can download Popcorn Theme by logging into the account created for you when purchasing and clicking on the appropriate link.

Should you not receive an email containing your information, you can contact us to request your purchase information.

Access to re-download purchased files will be granted so long as your license key is valid. If a license key expires, download access to the associated files will be discontinued until such time as the license key is renewed.

7. Ownership

All themes and plugins are property of Alexdigital LTD. Claiming any type of intellectual or exclusive ownership rights of our products is strictly prohibited.

Our theme and plugins are provided “as is” without warranty of any kind, expressed or implied. We shall not be liable for any damages, including but not limited to, direct, indirect, special, incidental or consequential damages or losses that occur due to the use or inability to use our themes and plugins.

8. Website, Theme & Plugin Content

All content found on this site and throughout the theme including images, documentation, support queries and any other information is property of Alexdigital LTD and may not be redistributed without permission or consent.

9. Pricing

Alexdigital LTD reserves the right to modify, change, cancel or upgrade a theme subscription and/or license key without prior notice or consent. Prices of all products are subject to change without prior notice or consent.

All prices are in USD.

10. Refund Policy

We firmly believe in and stand behind our product 100%, but we understand that it cannot work perfectly for everyone all of the time. If you are unhappy with your purchase, or you have an issue that we are unable to resolve that makes the system unusable, we will be happy to consider offering a refund.

Refunds will be offered at our sole discretion and must meet all of the following conditions fully:

• You are within the first 14 days of the purchase of the theme.
• No refunds will be granted after the first 14 days of the original purchase whatsoever.
• Refunds will not be granted to customers who have violated our terms and had their license key disabled.

Please note that the 14 day period begins from the date of your first purchase. This policy does not include license renewals, upgrades or additional purchases after you’ve already been refunded. 

By purchasing theme and plugin(s) from our site, you agree to this refund policy and relinquish any rights to subject it to any questions, judgment or legal actions.

If a refund is accepted, you will receive the amount you paid in USD.

11. Email

Alexdigital LTD may occasionally send you emails related to the purchase of product(s) from our company. We may also send you occasional email newsletters relating to Popcorn Theme updates, promotions, Popcorn Theme extensions and the like. We will never sell or release your email to any third party vendors. You may opt out of these emails at any time without penalty.

12. Forums

We may offer forums, blogs, comments areas, bulletin boards and chat rooms (collectively, “Forums”) that are intended to provide users an interesting and stimulating forum in which they can express their opinions and share their ideas. We do not endorse the accuracy or reliability of any advice, opinion, statement or information posted on these Forums. Please use your best judgment, and be respectful of other individuals using these Forums. Do not use vulgar, abusive or hateful language. Uploading copyrighted or other proprietary material of any kind on the Service without the express permission of the owner of that material is prohibited and may result in civil and/or criminal liability. Information in our private information field is visible to all customer support members. Please use temporary login details if posting them, and change/delete them once the topic is resolved. Any information you disclose when posting a message in these Forums may become public. You should not include any information in your posting that you do not want other parties to see or use and you hereby agree that you will not hold Alexdigital LTD responsible for any third party’s use of information contained in such posting.

You agree not to use user names or Forum titles that are offensive, obscene, or harassing to others. We reserve the right to require you to change your user name or the title of your Forum at any time and for any reason in our sole discretion.

13. Cookies

Like most interactive web sites this Company’s website uses cookies to enable us to retrieve user details for each visit. Cookies are used in some areas of our site to enable the functionality of this area and ease of use for those people visiting. Some of our affiliate partners may also use cookies. In order to enhance your experience we use these cookies to monitor how visitors interact with our site. For instance, we use Google services (including Google Analytics and Google Adwords). This data helps us to improve our offering and bring you the products and information that you are most interested in.

We also use Google Adwords remarketing service to offer off-site advertising to those who have previously visited our site. As such 3rd party vendors, including Google, may use these cookies to serve our adverts on websites across the internet. 3rd party vendors, including Google, will use the cookies picked up during your visit to serve ads based on your past visits to our website.

We do not monitor or review the content of other party’s websites which are linked to from this website. Opinions expressed or material appearing on such websites are not necessarily shared or endorsed by us and should not be regarded as the publisher of such opinions or material. Please be aware that we are not responsible for the privacy practices, or content, of these sites. We encourage our users to be aware when they leave our site & to read the privacy statements of these sites. You should evaluate the security and trustworthiness of any other site connected to this site or accessed through this site yourself, before disclosing any personal information to them. This Company will not accept any responsibility for any loss or damage in whatever manner, howsoever caused, resulting from your disclosure to third parties of personal information.

15. License Agreement

By purchasing our product(s), you indicate and consent that you have read and agree to the Terms & Conditions listed and detailed on this page. We reserve the right to change or modify the current Terms and Conditions without prior notice or consent.

16. Severability 

If any part of this agreement is declared unenforceable or invalid, all remaining clauses in this agreement shall remain binding on the customer.
